VA Ends Automatic FBI Background Check Reporting for Veterans in Fiduciary Program

Policy Change Separates Financial Assistance from Firearm Restrictions

The VA Fiduciary Program is designed to protect beneficiaries who are unable to independently manage their VA financial benefits due to disability, illness, or other circumstances. When a Veteran is enrolled in the program, a fiduciary is appointed to oversee the management of benefit payments.

Under a prior policy that had been in place for decades, the VA would report certain fiduciary determinations to the FBI’s NICS database. Placement in the database prevented individuals from purchasing firearms under federal law.

The VA announced in February 2026 that this automatic reporting practice has been discontinued.

 

Due Process Concerns Cited by VA Officials

According to the department, participation in the fiduciary program does not necessarily indicate that a Veteran has been legally declared mentally incompetent or poses a safety risk.

The agency stated that financial management assistance alone does not meet the legal standards that federal firearm laws require for restricting firearm purchases.

As part of the policy change, the VA is coordinating with federal partners to review and remove prior entries in the background check system that were based solely on fiduciary program participation.

 

Court-Ordered Restrictions Remain in Effect

The VA emphasized that firearm purchase restrictions remain in place when they arise from formal legal determinations. Examples include:

  • Court findings that an individual is a danger to themselves or others
  • Judicial determinations of mental incompetence under applicable law

In those circumstances, reporting to federal background check systems may still occur through the appropriate legal channels.
