VA Finalizes Rule Restricting Apportionment of Veterans Disability Payments

Federal Rule Ends Hardship-Based Apportionment Requests

Apportionment is a mechanism within the VA benefits system that allows the agency to divert a portion of a Veteran’s benefit payment to a spouse, child, or dependent when the Veteran is not providing financial support.

For decades, dependents could submit requests directly to the VA seeking a share of the Veteran’s monthly benefit if they demonstrated financial hardship and lack of support. Claims processors within the VA would evaluate the circumstances and determine whether to redirect a portion of the payment.

The newly finalized regulation eliminates that hardship-based pathway. Going forward, the VA will no longer process new apportionment claims based solely on a dependent’s financial need.

Instead, the agency states that disputes over financial support between Veterans and family members should generally be handled by state courts, which traditionally have jurisdiction over child support and other family law matters.

Limited Circumstances Remain for Apportionment

Although hardship claims are being discontinued, the regulation preserves certain statutory circumstances in which apportionment may still occur. These typically involve legal obligations that arise from court determinations or other specifically authorized situations under federal law.

The VA stated that narrowing the scope of apportionment is intended to align benefits administration with the appropriate legal venues responsible for resolving family financial disputes.

Impact on Existing and Future Claims

The policy change affects several benefit programs administered by the VA, including:

  • Disability compensation
  • VA pension benefits
  • Dependency and Indemnity Compensation (DIC)

Dependents seeking financial support from a Veteran’s benefits will generally need to pursue remedies through state family courts rather than filing hardship requests through the VA.

Existing apportionments that were granted prior to the rule’s effective date may continue depending on the circumstances of each case.
